תנאי השימוש של FitAround

ברוכים הבאים ל-FitAround — פלטפורמת SaaS לניהול סטודיו כושר ובריאות. השימוש בשירות כפוף לתנאים המפורטים להלן. שימוש בשירות מהווה הסכמה לתנאים אלה.

1. מי אנחנו ומי אתם

FitAround מספקת תשתית תוכנה לבעלי סטודיו ("סטודיו") לניהול שיעורים, מתאמנים, מנויים וגבייה. מתאמנים ("חברים") משתמשים בשירות כדי להירשם לשיעורים ולנהל את המנוי שלהם מול הסטודיו הרלוונטי. FitAround אינה צד להתקשרות שבין הסטודיו למתאמן, ואינה נותנת ייעוץ כושר, תזונה או רפואי מכל סוג.

2. הרשמה וחשבון

עליכם לספק מידע מדויק ועדכני בעת ההרשמה, ולשמור על סודיות פרטי הגישה לחשבונכם. אימות הזהות מתבצע באמצעות מספר טלפון וקוד חד-פעמי (SMS).

3. מנוי וחיוב (לסטודיו)

סטודיו הנרשם לשירות מקבל תקופת ניסיון בחינם. בתום תקופת הניסיון, אמצעי התשלום שנשמר יחויב אוטומטית בהתאם למסלול שנבחר, אלא אם המנוי בוטל לפני מועד זה. ניתן לבטל בכל עת דרך הגדרות הסטודיו. במקרה של כשל בגביה, השירות ינסה לחייב שוב לפי לוח זמנים קבוע; לאחר מספר ניסיונות כושלים החשבון עלול להיות מושהה (ללא מחיקת מידע).

4. שימוש הוגן

אין לעשות שימוש בשירות באופן המפר חוק, פוגע בצדדים שלישיים, או מנסה לעקוף מגבלות טכניות (לדוגמה: ניסיון גישה בלתי מורשית לנתוני סטודיו אחר, או שימוש אוטומטי המעמיס על המערכת).

5. אחריות הסטודיו למידע הבריאותי

הצהרות בריאות שממלאים המתאמנים מיועדות לשימוש הסטודיו בלבד, לצורך הערכת התאמה לפעילות גופנית. FitAround מספקת את הכלי הטכני לאיסוף ואחסון ההצהרות בלבד, ואינה אחראית לתוכן ההצהרות, לנכונותן, או להחלטות הסטודיו על בסיסן.

6. קניין רוחני

כל הזכויות בתוכנה, בעיצוב ובסימני המסחר של FitAround שמורות לנו. תוכן שמעלה סטודיו (שמות שיעורים, תיאורים, מדיניות) נשאר בבעלותו.

7. הגבלת אחריות

השירות ניתן כפי שהוא ("AS IS"). ככל שיתאפשר על פי דין, FitAround לא תישא באחריות לנזק עקיף, תוצאתי, או לאובדן הכנסה הנובע משימוש בשירות.

8. סיום התקשרות

ניתן להפסיק את השימוש בשירות בכל עת. FitAround רשאית להשעות או לסגור חשבון המפר תנאים אלה, לאחר יידוע סביר ככל שניתן.

9. דין וסמכות שיפוט

תנאים אלה כפופים לדין הישראלי, וסמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים בישראל.

FitAround Terms of Service

Welcome to FitAround — a SaaS platform for fitness and wellness studio management. Use of the Service is subject to the terms below. Using the Service means you accept these terms.

1. Who we are, who you are

FitAround provides software infrastructure for studio owners ("Studio") to manage classes, members, subscriptions and billing. Trainees ("Members") use the Service to book classes and manage their membership with the relevant studio. FitAround is not a party to the relationship between a Studio and its Members, and does not provide fitness, nutrition, or medical advice of any kind.

2. Registration and account

You must provide accurate, current information when registering, and keep your account credentials confidential. Identity verification is performed via phone number and a one-time SMS code.

3. Subscription and billing (Studios)

A Studio signing up gets a free trial period. At the end of the trial, the saved payment method is charged automatically per the selected plan, unless cancelled beforehand. Cancellation is available anytime from studio settings. On a failed charge, the Service retries on a fixed schedule; after repeated failures the account may be suspended (data is never deleted as a result).

4. Fair use

You may not use the Service in a way that violates law, harms third parties, or attempts to circumvent technical limits (e.g. attempting unauthorized access to another studio's data, or automated use that overloads the system).

5. Studio's responsibility for health data

Health declarations completed by Members are intended for the Studio's own use, to assess fitness for physical activity. FitAround provides only the technical tool to collect and store these declarations, and is not responsible for their content, accuracy, or the Studio's decisions based on them.

6. Intellectual property

All rights in FitAround's software, design, and trademarks are reserved. Content a Studio uploads (class names, descriptions, policies) remains the Studio's own.

7. Limitation of liability

The Service is provided "as is." To the extent permitted by law, FitAround is not liable for indirect, consequential damages, or loss of revenue arising from use of the Service.

8. Termination

You may stop using the Service at any time. FitAround may suspend or close an account that violates these terms, with reasonable notice where practicable.

9. Governing law

These terms are governed by Israeli law, and the competent courts of Israel have exclusive jurisdiction.
